Hockey Life HK Liability Waiver
Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement
This Liability Waiver (“Agreement”) is entered into by the registered participant (“Participant”) and, where applicable, the parent or legal guardian of the participant (“Guardian”), in favor of Hockey Life (Hong Kong) Limited (“Hockey Life HK”), its directors, officers, employees, volunteers, agents, sponsors, and all affiliated entities (collectively, the “Released Parties”).
By purchasing coaching services from Hockey Life HK, the Participant acknowledges and agrees to the following terms and conditions regarding participation in any sports, recreational, or physical activities, including but not limited to training sessions, games, competitions, practices, events, and related activities (the “Activities”) organized, sponsored, or hosted by the Released Parties.
1. Acknowledgment and Assumption of Risks
The Participant acknowledges that participation in the Activities involves inherent risks, dangers, and hazards that can result in serious personal injury, illness, permanent disability, death, or property damage. Such risks may include, but are not limited to:
- · Collisions with other participants, spectators, or equipment
- · Slips, trips, and falls
- · Exposure to weather, temperature extremes, or environmental conditions
- · Physical contact, sprains, strains, fractures, and other bodily injuries
- · Accidents during travel to or from any Activity location
- · Potential exposure to communicable diseases, including but not limited to COVID-19, influenza, or other viruses and bacteria
- · Equipment failure or misuse
- · Lack of hydration or nourishment
- · Acts or omissions of other participants, staff, or volunteers
The Participant freely accepts and fully assumes all risks, dangers, and hazards, whether known or unknown, foreseeable or unforeseeable, associated with the Activities.
2. Release and Waiver of Liability
The Participant, for themselves and on behalf of their heirs, assigns, personal representatives, and next of kin, hereby fully and forever releases, waives, discharges, and covenants not to sue the Released Parties for any and all claims, demands, losses, damages, actions, causes of action, or expenses (including attorney’s fees and costs), whether in law or equity, arising out of or relating to any injury, illness, disability, death, property damage, or loss suffered as a result of participation in or attendance at the Activities, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.
3. Indemnification and Hold Harmless
The Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, damages, losses, liabilities, judgments, or expenses, including attorney’s fees, arising from or related to the Participant’s involvement in the Activities, including but not limited to:
- · Injury or damage to person or property
- · Violation of any law, rule, or regulation by the Participant
- · Any negligent or intentional act or omission by the Participant
4. Medical Treatment
The Participant authorizes the Released Parties to provide or obtain emergency medical treatment for the Participant if, in the Released Parties’ opinion, such treatment is necessary. The Participant assumes full responsibility for all costs associated with such medical care, transportation, and related expenses.
5. Physical Condition and Insurance
The Participant represents and warrants that they are in good health and do not have any medical condition, disability, or impairment that would prevent or limit safe participation in the Activities. The Participant agrees to notify the Released Parties of any such condition. The Participant further acknowledges that it is their sole responsibility to obtain appropriate health, accident, or personal liability insurance coverage, and that the Released Parties do not provide such insurance.
6. Compliance with Rules and Instructions
The Participant agrees to abide by all rules, policies, instructions, and directions provided by the Released Parties, coaches, officials, and staff at all times during the Activities. The Participant understands that failure to comply may result in disciplinary action, including removal from the Activities without refund.
7. Media Release
The Participant grants the Released Parties the right to photograph, videotape, or otherwise record their participation in the Activities and to use such images or recordings for promotional, educational, or other lawful purposes, without compensation or prior notice. The Participant waives any right to inspect or approve the finished product or any use thereof.
8. Severability
If any provision of this Agreement is found to be invalid or unenforceable by a court of law, such provision shall be severed, and the remaining provisions shall continue in full force and effect.
9. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Activities are conducted. Any disputes arising from or relating to this Agreement shall be resolved exclusively in the courts of that jurisdiction.
10. Acknowledgment of Understanding
By purchasing coaching services from Hockey Life HK, the Participant acknowledges and represents that they have read this Agreement in its entirety, fully understand its terms, and voluntarily agree to be bound by them. The Participant understands that they are giving up substantial rights by acknowledging this Agreement, including the right to sue, and signs it freely and voluntarily without any inducement, assurance, or guarantee being made to them.
